Preamble
These Terms of Use (hereinafter the "Terms") define the conditions of access to and use of the GrindLab service, accessible at https://www.grindlab.gg (hereinafter the "Website"), published by Pauthom (hereinafter the "Publisher").
Any registration or use of the Service implies unreserved acceptance of these Terms. If the User does not accept these Terms, they must refrain from using the Service.
Article 1 — Definitions
"User Content": all data, information and content generated or imported by the User when using the Service, including hand histories, custom ranges, notes, tags and simulation results.
"Publisher": Pauthom, a French Simplified Joint-Stock Company (SAS) with a share capital of €600, registered with the Lyon Trade and Companies Register under number 103 033 486, with its registered office at 26 Rue Lalande, 69006 Lyon, France.
"Service" or "GrindLab": all features offered by the Publisher via the Website, including the equity calculator, range editor, hand history import, Risk Premium (RP) engine and session history.
"Website": the website accessible at https://www.grindlab.gg.
"User": any natural person who has created an account on the Website and uses the Service.
Article 2 — Purpose
These Terms define the conditions under which the Publisher makes the GrindLab Service available to Users, and the conditions under which Users access and use the Service.
GrindLab is a poker analysis and study tool, accessible via a web browser. GrindLab is not a gambling platform and does not allow Users to play poker, bet or wager money in any way.
Article 3 — Access and Registration
3.1 — Eligibility
Access to the Service is reserved for natural persons who are at least eighteen (18) years old and have full legal capacity. By registering, the User represents and warrants that they meet these conditions.
3.2 — Registration
Registration for the Service is carried out via third-party authentication (OAuth) using a Google or Discord account. The User authorizes the Publisher to access the profile information provided by these third-party services in accordance with the Privacy Policy.
The User is solely responsible for the confidentiality of the login credentials for the third-party account used to connect to the Service.
3.3 — Single account
Each User may only have one account. Creating multiple accounts is prohibited and may result in the suspension or deletion of all accounts concerned.
Article 4 — Service Description
4.1 — Features
The Service offers the following features, subject to availability depending on the subscription plan:
- Equity calculator: Monte Carlo simulation of hand equity against one or more opponent ranges, from preflop to river.
- Hand history import: automated import of hand histories from online poker rooms, with parsing of positions, actions and boards.
- Range editor: creation, editing, weighting and saving of custom ranges via an interactive 13×13 matrix.
- Session history: automatic saving of simulations with notes, tags and favorites.
- Risk Premium (RP) engine: analysis of tournament scenarios taking into account Risk Premium.
4.2 — Service evolution
The Publisher reserves the right to develop, modify, suspend or remove any feature of the Service, at any time and without notice. The Publisher will endeavor to inform Users when such changes substantially affect the use of the Service.
4.3 — Beta phase
During the open beta phase, all features are accessible free of charge. The User acknowledges that the Service is under development and may contain malfunctions, errors or interruptions. The Publisher does not guarantee the continuous availability of the Service during this phase.
Article 5 — User Obligations
5.1 — Lawful use
The User undertakes to use the Service in accordance with these Terms, applicable laws and regulations, and in respect of third-party rights.
5.2 — Prohibited uses
The User shall refrain from:
- Using the Service for unlawful, fraudulent or public-order-violating purposes;
- Attempting to gain unauthorized access to the Service, servers or databases;
- Reverse engineering, decompiling or disassembling the Service;
- Automated extraction, collection or scraping of data from the Service;
- Using automated scripts, bots or crawlers;
- Reproducing, copying, selling or commercially exploiting all or part of the Service;
- Disrupting the normal operation of the Service;
- Impersonating a third party or creating a false profile;
- Sharing access to the Service with third parties.
5.3 — Accuracy of information
The User warrants the accuracy of information provided during registration and undertakes to update it in case of any change.
Article 6 — Intellectual Property
6.1 — Publisher's rights
All elements constituting the Service and the Website are and remain the exclusive property of the Publisher or its licensors, protected under the French Intellectual Property Code and applicable international laws.
Registration grants the User a personal, non-exclusive, non-transferable right to use the Service for the duration of their registration.
6.2 — User Content
The User retains all intellectual property rights over User Content they create or import into the Service.
The User grants the Publisher a non-exclusive, royalty-free license, limited to the duration of use, solely for providing, maintaining and improving the Service.
The Publisher shall not use User Content commercially for any purpose other than providing the Service, except for anonymized and aggregated data for statistical purposes.
6.3 — Aggregated and anonymized data
The Publisher reserves the right to use anonymized and aggregated data derived from use of the Service, for improvement, research, development and statistics.
Article 7 — Personal Data
The collection and processing of Users' personal data are governed by the Privacy Policy, which forms an integral part of these Terms.
Article 8 — Service Availability
8.1 — Best efforts obligation
The Publisher undertakes to use reasonable efforts to ensure continuous access to the Service. This constitutes a best efforts obligation, not a guarantee of result.
8.2 — Maintenance
The Publisher reserves the right to temporarily suspend access for maintenance operations, without obligation to compensate Users.
Article 9 — Liability
9.1 — Limitation of the Publisher's liability
GrindLab is an analysis and study tool. It does not constitute gambling advice, financial advice or an incentive to gamble. The Publisher does not guarantee any financial result related to the use of the Service.
Equity calculations, simulations and analyses are based on mathematical models (Monte Carlo simulation) and rely on theoretical assumptions.
The Publisher's total aggregate liability is capped at the total amount paid by the User during the twelve (12) months preceding the event. For free-tier Users, this cap is zero (0) euros.
9.2 — User's liability
The User is solely responsible for their use of the Service and their decisions. The User acknowledges that poker involves inherent financial risks and that the use of an analysis tool does not eliminate or reduce such risks.
9.3 — Force majeure
The Publisher shall not be held liable for force majeure events as defined under Article 1218 of the French Civil Code.
Article 10 — Third-Party Content and External Links
The Service may contain links to third-party services. The Publisher is not responsible for the content or practices of these third-party services.
The import of hand histories from online poker rooms is carried out under the User's sole responsibility.
Article 11 — Suspension and Termination
11.1 — By the Publisher
The Publisher reserves the right to suspend or terminate a User's access in the event of breach of these Terms, fraudulent behavior, false information or non-payment.
11.2 — By the User
The User may terminate their account at any time by email to grindlab.gg@gmail.com.
11.3 — Effects of termination
Upon termination: access will be deactivated, User Content will be deleted within thirty (30) days, except where legally required. The User may request an export of their User Content before termination.
Article 12 — Plans and Pricing
12.1 — Free plan
The Publisher offers a free plan whose scope may be modified at any time.
12.2 — Paid plans
Paid plans will be subject to specific Terms of Sale accessible from the Website.
12.3 — Promotional offers
Promotional offers (including "Early Bird") are subject to specific conditions set out in the applicable Terms of Sale, subject to availability.
Article 13 — Modifications to the Terms
The Publisher reserves the right to modify these Terms at any time. Users will be notified of substantial modifications at least fifteen (15) days before they take effect. Continued use constitutes acceptance.
Article 14 — Right of Withdrawal
14.1 — Consumer Users
In accordance with Article L221-18 of the French Consumer Code, consumer Users have a right of withdrawal of fourteen (14) days from the date of subscription to a paid plan.
In accordance with Article L221-28, 13° of the French Consumer Code, this right may not be exercised for digital content whose performance has begun with the consumer's express consent.
14.2 — Exercising the right of withdrawal
The User must notify their decision by email to grindlab.gg@gmail.com within the fourteen (14) day period. The refund will be processed within fourteen (14) days.
Article 15 — Dispute Resolution
In the event of an unresolved dispute, consumer Users residing in France or the EU may use a consumer mediation service free of charge.

Article 16 — General Provisions
These Terms, the Privacy Policy and, where applicable, the Terms of Sale constitute the entire agreement between the User and the Publisher. If any provision is declared null, the remaining provisions shall remain in full force and effect.
Article 17 — Governing Law and Jurisdiction
These Terms are governed by French law.
For professional Users: the courts of Lyon shall have exclusive jurisdiction.
For consumer Users: in accordance with the French Consumer Code, the User may bring proceedings before any court having territorial jurisdiction.
